Attorney’s fees denied in “Dyas Triangle” lawsuit

The request by the city of Fairhope and Mayor Tim Kant to recover $1.2 million in attorney’s fees from the plaintiffs in the “Dyas Triangle” lawsuit was denied Wednesday in an eight-page order.

U.S. District Judge William S. Steele, who issued the order on March 9 denying the defendants’ request for attorney’s fees in the complex lawsuit soon to be three years old, also sent the lawsuit back to Baldwin County Circuit Court for trial where it was initially filed in April 2008.
