Baldwin County grand jury to review drug, theft cases

BAY MINETTE, Ala. — The Baldwin County grand jury will review evidence against a Loxley man arrested Aug. 19 near his home and charged with possession of 2.2 pounds of marijuana for distribution, according to District Court records.

Michael Howard Patch, 50, of Trace Drive was charged with trafficking marijuana and possession of drug paraphernalia. He was released on $50,000 bail.

Bail originally was set at $1 million, but was reduced, following a motion from defense attorney James Scroggins, who argued that Patch was not a flight risk.

According to the motion, Patch has no prior felony convictions and was employed more than four years in the Daphne office of with Henry Schein Dental Co.

Other cases for review by the grand jury include:

• Benjamin Tyree Jackson, 31, of Jupiter Street, Foley, who was arrested Aug. 6 after allegedly attempting to distribute crack cocaine Aug. 2 and Aug. 3 near his home, according to court records.

Jackson is charged with two counts of distribution of a controlled substance, two counts of possession of a controlled substance, and second-degree possession of marijuana.

He remains at Baldwin County Corrections Center on $26,000 bail.

• Nelson L. Garmendia, 37, of Miami, who is charged with receiving more than $5,000 in stolen items from Tanger Outlet in Foley.

According to court documents, he received shoes, purses, billfolds and other items Aug. 6.

Garmendia was arrested Aug. 9. He remains incarcerated on $7,500 bail.

• Richard James McGaster, 27, of Pecan Street, Foley, who allegedly sold one ounce of powder cocaine to a confidential source May 6 in the Foley WalMart parking lot.

McGaster was arrested Aug. 20 and was released after posting $10,000 bail.

• Zachary Paul Mutual, 22, of Hope Drive, Daphne, charged with attempting to distribute morphine near Kohl’s in Spanish Fort on July 12, according to court documents.

He was released on $10,000 bail.
