Bankruptcy lawsuit seeks $117,000 from city of Fairhope

FAIRHOPE, Ala. - The city of Fairhope was sued last month in a bankruptcy proceeding involving utility payments received from Bruno’s Supermarkets LLC.

The lawsuit brought in U.S. Bankruptcy Court in Birmingham seeks $117,000 for utility services received by the city from Bruno’s within 90 days of the company declaring bankruptcy in 2009, according to court records.

The plaintiff bankruptcy trustee in the case also seeks costs and attorney’s fees from the city.

A Food World grocery store in Fairhope closed its doors in 2009 following its parent company Bruno’s LLC’s bankruptcy announcement. A Bruno’s Supermarket continues to operate in Fairhope across Greeno Road from where the Food World was located.
