SPANISH FORT, Ala. — The attorney for a man listed as a “person of interest” in the brutal attack of local business owner Bobby Wilson filed a motion to suppress a search warrant for his client.
On Nov. 20, attorney John Beck filed the motion to suppress a search warrant for his client, Leslie Eric Buzbee. Buzbee was arrested on Sept. 21 for possession of a drug paraphernalia charge. The Baldwin County Sheriff’s Department named Buzbee “a person of interest” in the severe beating and robbery of Wilson at Wilson’s Service Center on Aug. 11.
“We felt the affidavit was grossly exaggerated and inaccurate,” Beck said last week from his Fairhope office. “We feel Mr. Buzbee should be cleared of any level of suspicion immediately. The best thing that can happen for the Wilson family and the Buzbee family is for Mr. Wilson to recover from the attack with his memory intact, and that would take any and all mystery out of this case.”
Beck said he filed a motion to suppress the search warrant in the drug paraphernalia case that was extremely detailed and approximately 10 pages long.
In his motion, Beck states that in addition to Buzbee’s address being incorrect, the property seized, which included $940 in cash, rifles and cartridges, belonged to Buzbee’s relatives.
According to Beck, Buzbee attempted to “plant” a rumor about possibly winning the lottery to someone to see if that person would be the “leak” concerning other rumors.
Beck also disputed items listed in the affidavit. In regards to “additional information,” the person who said Buzbee made incriminating statements is a drug dealer who later recanted his statement.
Beck’s said his hope is that the Baldwin County grand jury will hear this case, and he hoped that if sent to the grand jury it be presented neutrally by the district attorney’s office.
Baldwin County District Attorney Judy Newcomb was contacted Dec. 5, and she declined to comment on the case due to the ongoing investigation. Spanish Fort police Chief David Edgar referred all questions to the district attorney’s office.
Beck said he wants to see a grand jury “no-bill”, Buzbee’s case and exonerate him from any suspicion. A no bill is a decision by the grand jury not to indict a person.
Beck said he has not heard of any evidence coming back from the Department of Forensics Science but is concerned that in a case of this magnitude that evidence results be turned around quickly.
Beck said he is only privy to information about the evidence if the district attorney decides to give it to him, he said. Beck said he doesn’t expect to hear back from the district attorney.
There was a search warrant executed on Buzbee’s residence and the police were looking for things associated with the crime, Beck said. They didn’t find anything except allegedly a piece of drug paraphernalia, he said. Law enforcement officials have to file an affidavit to support the search warrant which is a sworn statement by a law official that shows probable cause for search of a residence, he said.
“We filed a motion to suppress because there is no probable cause,” Beck said.
Beck also included details of the defense’s own investigation performed by Baldwin Legal Investigations, a private investigative firm hired by the Buzbee family.
“My filing speaks for itself. It really details what we found in our investigation,” he said. “We will continue to wait and see what happens in this investigation.”
He said that this has been a tremendous strain on the Buzbee family and they are hoping it is resolved before Christmas.
“I think the most important thing is that we all want Mr. Wilson to get better,” he said.
Beck said he has not heard anything from the district attorney’s office since the motion was filed. Beck expects the next court date for the misdemeanor charge to be in mid to late January. There is no official court case on the robbery and assault, he said.
