FOLEY, Ala. — Club Evolution, the Foley nightclub that has been a focus of controversy since late last year, could be looking at possible revocation of its business license.
Foley City Council voted on Monday to set a public hearing regarding the Club’s business license.
“We’ve had some complaints, and we’ve had the undercover officer go down there, so we have some things we feel we need to act upon in the public interest,” said Mayor John Koniar following the council meeting.
Koniar did not specify what the complaints were.
“They’ll have their day,” he said of the club’s management having a chance to present its side at the public hearing.
A spokeswoman at City Hall said certified letters have to be sent out regarding the public hearing and that could take approximately 10 days. Also, city officials are in discussion with the city attorney on the matter and it could be at least 10 days to two weeks before the public hearing date is set, she said.
Club Evolution and its owner, Sixto Riviera Jr., were at the forefront of opposition to a “last call” for alcohol ordinance that was approved by the city in January. Riviera charged his club was being targeted by the new ordinance which prohibits the sale of alcohol in city clubs and lounges between the hours of 2 a.m. to 6 a.m. The last call ordinance had the support of Foley Police Department, which pointed out that 300 DUI arrests on average a year have been occurring in the city for the past few years.
Riviera has also charged that the alleged targeting of his club by police was based on the perception of some that Club Evolution is a “gay” bar, something Riviera denied. He did say female impersonators are sometimes part of the entertainment that he alleged was putting Foley on the map with tourists as a night life destination.
