Council declares public nuisance at two properties in Loxley

LOXLEY, Ala. – The Loxley Town Council passed three resolutions at its meeting Monday night declaring a public nuisance at residences on County Road 49 and Grimes Lane.

Following public hearings held at the outset of Monday’s meeting in which there was no public comment, the council passed the resolutions unanimously with all council members present at Monday’s meeting.

The first two resolutions involved property at 29990 County Road 49, the first pertaining to overgrown grass and weeds, debris and stagnant water, the second pertaining to junk, while a second property at 71 Grimes Lane was cited for overgrown grass and weeds.

In all three cases the property owner has 15 days to “abate and remove” the nuisance, at which time the town will remove the nuisance and assess a cost to the property owner for removal.

In other business Monday the council passed a resolution to put a lien of $3,000 on property at 3101 S. Holley St., to recover costs for demolition of a residential structure on the property.

The Council voted in July to condemn the property and have the structure removed by an outside contractor at a cost of $2,600. The property owner was assessed the cost of demolition, plus $400 in legal fees.

In other business, the council:

• Approved an alcohol application license for O and F Development LLC for Cellar Door Loxley, located at 3300 S. Hickory St. Suite C.

• Agreed to serve as a sponsor for the Fourth Grade Foresters project, which would include students from Rosinton and Loxley schools. As a sponsor, the town would provide individually packaged 12- to 18-inch trees at a cost of $1.59 per tree. Mayor Billy Middleton said it was unknown as of Monday exactly how many trees the town would sponsor, but that it would be less than 100 at a cost of about $175 to the town.

• Passed three items necessary for adoption as part of the town’s drug free workplace policy.

The first action was to adopt the Alabama Drug Free Workplace Policy which was a general policy that would cover all town employees.

The second was to adopt the FTA Policy and Forms Toolkit, which covered all town employees whose job responsibilities required driving.

The final action was to adopt the FMCSA Policy and Forms Toolkit, which covered employees that required a CDL license for their job responsibilities.
