Council tables action on towing fee levy

SILVERHILL, Ala. — The Silverhill Town Council once again tabled action on a proposed ordinance which would levy a towing fee of $250 on vehicles where traffic citations involve alcohol or drug related arrests.

The ordinance proposal was initially brought before the council at its July 5 meeting and was presented to the council for consideration at its July 18 meeting, but was tabled after attorney Josh Myrick expressed concerns about the ordinance.

The ordinance was presented to the council again at Monday’s meeting, but was again tabled after it was found that corrections to some of the wording in the ordinance needed to be made.

The ordinance would require the owner of the vehicle to fill out a form and return the form to the chief in order to retrieve the vehicle. The ordinance would require the cooperation of Dixie Towing, which handles the towing for most of the town vehicles.

The ordinance would only involve vehicles in which an arrest involving drugs or alcohol has been made, such as a DUI or stop in which drugs are found in the vehicle.

When the ordinance was presented for consideration in July, it was reported that 39 arrests in which the fee would have been enforced if the ordinance were currently in effect. Chief Kim Wasdin said Monday that since the ordinance was initially presented, eight more arrests have been made which would have brought in $2,000 for the town. Monies from the fee would be used solely to purchase equipment for the police department.

“But we also don’t want to rush into anything and not do it right,” said Council member Shirley Stephens at Monday’s meeting.

The corrections would be made and presented to the council again for consideration at its Aug. 15 meeting.

Wasdin also presented a report at Monday’s meeting on two vehicles that were purchased from the town of Summerdale for the police department.

After some confusion was expressed at a previous meeting about insurance money from a previous vehicle that burned not covering the cost of purchasing equipment for the two vehicles as initially thought, Wasdin came back before the council Monday with a proposal that would resolve the matter.

The council voted unanimously Monday to purchase a camera for one of the vehicles. The council also agreed to hold off on purchasing radar equipment for the vehicle. Wasdin said a hand-held unit was available for use until monies were available to purchase a built-in unit for the vehicle.

Earlier in the meeting, the council approved the sale of surplus items including a 2003 Ford Crown Victoria, a 2005 Chevrolet Impala, a 1997 Oldsmobile Cutlass, a 2001 Ford Expedition and a 1988 Ford Ranger.

Monies raised from the sale of the surplus items can be used to purchase equipment for the vehicles.

The council also approved a resolution Monday setting up an account to be used as a Police Department equipment replacement fund.

In other business Monday, the council:

• Voted to close Water Department and Revenue savings accounts with funds totaling $9,568.47. The council had been charged a monthly fee for the accounts because they were considered dormant.

• Approved debt write-offs in the amount of $878.73.

• Voted to make an offer of $50,000 with a $30,000 tax donation for property on Highway 104. The measure passed 5-1 with Council member Bert Jones voting against the measure.

• Voted to give $50 to the Alabama Forestry Commission and the Arbor Day Foundation for the Alabama Tree Recovery Campaign to replace trees damaged during a rash of tornadoes in North Alabama.

• After meeting briefly in executive session, voted to approve a survey of blocks 3 and 4 in the town for pending litigation.

• Adjourned again to executive session to discuss a personnel matter.
