Detention ponds may bring problems

DAPHNE — A site plan review Thursday for lot 3 at Highway 64 Commercial Park received a favorable vote of 6-1, following a motion to reconsider the plans.

Planning Commissioners Ed Kirby, Larry Chason, DeLeon Thomas, Don Terry, Victoria Phelps and Mayor Fred Small voted for the approval. Commissioner Cathy Barnette, also a City Council member, cast the lone dissenting vote. Jeff Carrico was absent.

The site plans initially failed to pass the site review with a 3-4 vote. Commissioners Barnette, Thomas, Terry and Phelps voted against the plans.

At the site review, commissioners had asked Jason Estes, a developer with Engineering Development Services, about the detention pond’s maintenance and an overgrown ditch.

It was established that the state had control of the pond, according to Chason.

“None of the water goes through the ditch in question,” Planning Director Bill Eady said of the path the stormwater would take from the property to the detention pond.

Barnette and Thomas had concerns about approving plans for this subdivision while the pond received no maintenance.

“What is the city’s responsibility in a pond that we know has no maintenance?” Barnette asked of allowing developments to continue within this subdivision and of future projects in Daphne.

The Planning Commission voted to recommend to City Council that a moratorium be placed on future site plan applications unless they name the owner and those responsible for the maintenance of the respective detention pond.

The motion passed 6-1; Chason cast the lone dissenting vote.
