FAIRHOPE — The Fairhope City Council finally laid to rest the issue of short-term rentals at Monday evening’s meeting with final adoption of the zoning ordinance.

Short term rentals — anything under 30 days — will not be permitted in R1, R2 and R3 areas. Houses that have been rented out for short-term in the past will not be ‘grandfathered’ in. However, landlords will be permitted to fulfill any contracts they have. Once those expire, the property can no longer be rented out short term.

Councilmen Cecil Christenberry and Mike Ford thought there could be some revamping of the ordinance, and made a motion to send it back for revision.

Their motion was defeated, and another motion was made by Councilwoman Debbie Quinn to accept the ordinance as written, but to change the time limit from four weeks to 30 days.

This motion passed and the ordinance was adopted with a vote of 4 to 1.

The council then voted unanimously to annex several pieces of city property:

•3 acres located next to the current city landfill;

•3.89 acres located at Clay Pit;

•2 acres located north of the substation on Twin Beech Road and 1.66 acres at the same substation; and

•8 acres located at 19128 Young St.

In other action, the council:

•Authorized Mayor Tim Kant to accept a grant of $20,000 from Maddie’s Fund for The Haven;

• Authorized the mayor to purchase property located on the east side of Section Street, .0258 of an acre located about 34.51 feet north of Fairhope Avenue.

•Authorized the mayor to have an agreement between the city and the Baldwin County Commission to provide for continued maintenance of Thompson Hall Road.

The fourth resolution, to extend the landfill on South Section Street and apply for the required permits, was voted on, but not as it was initially presented.

When this issue was first brought up several council meetings ago, there were two options. Option A was to expand the landfill, which would extend its serviceability by 15 years. At this meeting, the council was told the expansion could extend the landfill’s serviceability by 30 years. Option B was to transport all the regulated waste material to the McBride Landfill.

Residents who lived around the landfill were against its expansion and advocated its removal.

Council members voted unanimously to go with Option B.

•Approved a request by Randy Lee to waive the permitting moratorium on property located at 18729 State Highway 181 for Affordable Plumbing.

•Approved Change Order No. 1 by John G. Walton Construction Co. for the Cliff Drive project on South Mobile Street, increasing the contract by $38,250.

•Approved Change Order No. 10 by J.F. Pate for additional work on the Faulkner State Community College buildout of the 2nd floor of the new Fairhope Public Library, increasing the contract by $2,017. This will be paid by Faulkner, not the city.

•Accepted the low bidder for the printing of “City Sketches.”

•Unanimously agreed to seek an agreement to purchase a percentage of gasoline from BP, which, officials said, will save the city between $150,000 and $175,000 a year.

The next regular meeting of the City Council will be held Monday, Aug. 13, 5:30 p.m., in Council Chambers.
