Fairhope noise law could change next week

FAIRHOPE, Ala. - A reduction in the maximum decibel level in the city’s noise ordinance could come up for a vote at Monday’s City Council meeting.

The proposed amendment to the existing law would reduce the maximum sound level between 6 a.m. and 10 p.m. from 85 to 65 decibels.

During a work session March 28, several residents sought that exact reduction in decibel level during a discussion on the issue, which was not advertised in advance. Unlike regular council meetings, work sessions currently do no have printed agendas; however, several supporters for a change in the law attended the work session meeting and were invited to speak on the issue by Council President Lonnie Mixon.

One local merchant who opposed a change in the law also spoke during the meeting.

The council has not had any publicized meetings since that March 28 meeting, but a proposed amendment is scheduled for a possible vote Monday.

Normally, proposed ordinances are introduced and then voted on two weeks later, unless the council votes unanimously to immediately consider the proposal. But the proposed changed in the city’s noise law leaves a blank space for the mayor’s signature, stating “adopted this 11th day of April, 2011.”

City records contained in the packet for Monday’s council meeting do not indicate which council member recommended the proposed change in the noise law.
