FOLEY, Ala. — Marlin Lashane Phipps was no stranger to trouble. The 33-year-old Foley man was booked into the Baldwin County Corrections Center 18 times between 1991 and 2006. He died from multiple gunshot wounds on a Sunday night, May 13, 2007, as he sat in his vehicle on 5th Avenue.
Phipps’ death was the beginning of big time trouble for Labarron Donte McDonald, arrested the following night for killing Phipps. The Santa Rosa County, Fla., Sheriff’s Office SWAT team and members of the U.S. Marshal’s Violent Fugitive Task Force arrested the 26-year-old at his residence in Milton, Fla. And now a Baldwin County jury has convicted McDonald of capital murder in Phipps’ death.
Testimony in McDonald’s capital murder trial in Bay Minette ended last week and jurors returned a guilty verdict on Monday. McDonald was to be sentenced on Tuesday but that sentence was unknown at press time.
The 9:30 p.m. shooting that Sunday night was the second homicide of 2007 in Foley. McDonald and Phipps allegedly had a longstanding fued going.
Attempts to reach lead prosecutor Michael Pylant for comment Tuesday afternoon proved unsuccessful.
