Foley City Council dealing with a thorny issue

FOLEY, Ala. — Of late, Foley City Council members have dealt with a number of issues and complaints relative to weeds. Monday’s council meeting was no different.

Council members agreed to set a public hearing to consider violations of the City’s Grass & Weed Abatement Ordinance at 501 E. Verbena Ave.

Then, in an effort to clean up what Councilman Ralph Hellmich said was the “clerical and administrative language” of the ordinance dealing with public nuisance lots, council members suspended the rules for immediate adoption of an amended ordinance.

Lastly, during visitor comments, the mayor and council heard a citizen say she has tried to deal with a neighboring property owner in connection with an overgrown fence but to no avail. City Environmental Manager Leslie Lassitter told the citizen that her office has been in contact with the property owner, who has promised to clean up the situation.

Mayor John Koniar told the citizen that if the situation isn’t remedied by the property owner in timely fashion the city would step in.

In other council action this week, the following funding allocations were made:

$33,000 to Hutcherson Moore & Rauch for what the mayor referred to as 2.9 miles of road resurfacing;

$6,895 for a JBC System III Wheel Balancer with Power Clamp, BFH Wheel Lift and 7 Cone Kit Set for the Public Works Department, with old equipment to be declared surplus and sold;

$1,495 for full color half-page ad in 2010 South Baldwin Area Guide;

$13,000 for Thompson Engineering plan to remove sampling wells as required by ADEM;

$2,440 for ADEM permit fee for the Northwest Quadrant Drainage Improvement Project.

First readings were approved for an ordinance amending Ordinance 557-98, which prohibits door-to-door solicitation in the city and an ordinance amending Ordinance 391-87 to provide parking, speed limits and traffic control within the City to include speed limits on County Road 12 South between Foley Beach Express and the intersection of Wolf Bay Drive. Also, approval was given for a first reading of the Planning Commission’s recommendation to rezone .486 acres from Agricultural Open to Residential Single-Family owned by James L. Underwood and located on the north side of West Fern Avenue, east of Majesty Loop.

Approval was given for the Jennifer Claire Moore Foundation’s use of the Horse Arena through Aug. 9, 2009 (with the exception of Aug. 1), with use of lights fee to be waived.

Approval was also given for Baldwin Tea Party’s request to use Heritage Park and Pavilion on Sept. 12, 2009, from 2 p.m. to 5 p.m. to hold a memorial in remembrance of the victims of 911 and what may be done to stop some actions of Congress.

With the Police Department’s recommendation, the council approved renewing a Retail Beer (On or Off Premises) and Retail Table Wine (On or Off Premises) for Country Corner Cafe Honduras Restaurant at 8950 Ala. Hwy. 59 South.

The council approved moving the first council meeting of September from Monday, Sept. 7 — Labor Day — to Tuesday, Sept. 8.

A resolution was approved to increase the annual T-Hangar lease amounts at Foley Municipal Airport. A resolution setting a funding mechanism through ALDOT was approved for the $450,000 grant for sidewalks.
