Foley man bound over on robbery charge

FOLEY, Ala. — The case of a Foley man who, along with his girlfriend, allegedly tried to rob a man in the Winn-Dixie parking lot on Sept. 15, 2009, has been bound over to the grand jury.

James Ellis Brown, 26, was charged with second-degree robbery and could face a prison term of two to 20 years on the felony charge.

According to the District Court warrant, Brown is accused of dropping off Brittany Barnes, 19, of Atmore, Ala., in the Winn-Dixie parking lot in Foley on the day in question. There she allegedley attempted to rob a Foley resident at gunpoint. Foley police said at the time that the victim was putting groceries in his car when Barnes approached him and tried to take his money.

The warrant further alleges that Brown parked his 1996 Mercury Grand Marquis in front of a nearby business and waited for Barnes.

A Foley Police Department spokesman said at the time of the incident that Barnes ran off when the victim told her that he didn’t have a wallet. A witness gave a description of the vehicle in which Brown and Barnes were in and that vehicle was later spotted in the Beulah Heights neighborhood. Brown and Barnes were arrested at a residence off of South Maple Street, the FPD spokesman said.

While the warrant lists Brown’s address as East Jefferson Street in Foley, the Baldwin County Corrections Center lists the address as Hoyle Avenue in Bay Minette.

Brown was released after posting a $10,000 bond.

In an unrelated incident, Jarred Allen Stewart, 24, of Magnolia Springs Highway in Foley has been bound over to the grand jury on a first-degree assault charge stemming from a Sept. 7, 2009, incident.

A District Court warrant says Stewart stabbed a man during an altercation at Wolf Bay Village Trailer Park in Elberta. The victim was stabbed in the left side of the chest and had to be lifeflighted to Baptist Hospital in Pensacola.

First-degree assault is a Class C felony that carries a prison term of not less than 10 years when a deadly weapon is used in the commission of the felony.

Stewart was released on a $10,000 bond following his arrest.
