LOXLEY — A former Loxley municipal court clerk has already pled guilty to two counts of obtaining criminal records illegally, is in more trouble.
According to on-line information from the Baldwin County Corrections Center, Katherine “Kay” Wilson HIcks, 52, was charged with first-degree “theft by deception.” According to news reports, she is accused of embezzling the money from the town.
According to the Code of Alabama, “The theft of property which exceeds two thousand five hundred dollars ($2,500) in value, or property of any value taken from the person of another, constitutes theft of property in the first degree.” She has been released on $20,000 bond.
Hicks’ address on current jail records is listed as Cardinal Drive in Robertsdale. She was previously listed as a resident of Daphne.
Hicks was charged in May with 11 counts of willfully seeking LETS criminal records under false pretenses, and nine counts of unauthorized use of a computer to to obtain criminal records of people through the LETS system. She pled guilty to two charges.
According to an Attorney General’s press release, Hicks received two suspended five-year sentences, three years of probation and fined $500 plus court and other costs on each count. As of this time, there is no word on how the new charges may affect her punishment.
