Baldwin County Circuit judge Charles Partin ruled late this afternoon that Angel Downs' Blackberry cellular device may be examined by FBI forensic experts, and that Stephen Nodine may not access common areas of his Orange Beach condo, according t assistant Distict Attorney David Matheny.
Murder suspect Nodine, a former Mobile County Commissioner, who moved from Mobile to Orange Beach, also must provide 12-hours advance notice for court approved trips and must not move without notifying the court for inspection to determine if the new location conflicts with house arrest guidelines.
Cell phone analysis may provide clues of Downs' calls minutes before her death.
Matheny filed the three motions early today. Court-appointed defense attorney Pascal Bruijn filed a motion for an "open file" of state's evidence, also approved this afternoon by Partin.
Nodine is charged with the May 9, 2010, murder of Downs, his lover for several years.
Matheny said District Attorney Hallie Dixon has established an "open file" policy, which allows defense attorneys to view evidence gathered by prosecutorial investigators.
