SEMINOLE, Ala. — Allen Dewayne Kleinschmidt, 34, of 19802 Bird Hog Road in Seminole, was arrested around 6:30 p.m. Wednesday night and taken to the Baldwin County Correctiional Facility in Bay Minette and charged with Criminal Littering, Failure to Bury and a Probation Violation. Bond is $500 for the two charges and no bond was set for the probation violation.
Baldwin County Sheriff’s officials could not be reached for comment as to what the probation violation was regarding or any details of the arrest.
The arrests came in connection with investigations by the Baldwin County Sheriff’s Department over the weekend into the death of several animals including a horse, donkey and several dogs owned by Kleinschmidt.
“We had calls that the suspect went out into the woods on his four wheeler and dumped the bodies of several dogs, a horse and donkey. We also had reports of animals on the property that were emaciated. (malnourished),” Maj. Anthony Lowery, Baldwin County Sheriff’s spokesman said.
According to Sheriff’s reports, Mr. Kleinschmidt alleges he thought he was dumping the animals on his property but was actually the property of his neighbor.
“She said she had gotten off early that day and heard a four wheeler and when she went back there, she saw the dead bodies. We have no indication of how long they had been there or how long he had been doing it. We do know he got rid of some of the animals but there were still some horses, dogs and possibly a deer on the property as of January 30,” said Captain Arthur of the Baldwin County Sheriff’s Department.
The Sheriff’’s investigation continues and Arthur said the Stare Department of Agriculture is also investigating allegations of animal cruelty to the existing animals on the property and checking on their condition.
There have not been any prior incidents at this property, Arthur said.
According to the Code of Alabama Animal Laws, Section 3-1-28, Disposing of animal carcasses, “All owners or custodians of animals which die or are killed in their possession or custody, other than such as are slaughtered for food, within 24 hours shall cause the bodies of such animals to be burned or buried at least two feet below the surface of the ground. No such animal shall be burned or buried sufficiently near a residence or residences as to create a nuisance. Any person violating this section, whether by failure to burn or bury an animal dying or being killed in his possession or by causing the same to be burned in such proximity to a dwelling or in such other way as to become a nuisance shall be guilty of a misdemeanor and, on conviction, shall be fined not more than $50”
Also, Alabama Code, Section 13A-7-29 states “litter” can apply to “dead animals or fowl”.
