Loxley Council approves split of Planned Unit Development

LOXLEY, Alabama — The Loxley Town Council voted on a pair of amendments to the town’s zoning ordinance Monday night, effectively splitting a planned unit development approved by the town six years ago.

In May of 2006 the Loxley Town Council approved the Golden Triangle PUD, an undeveloped property of just under 4,000 acres, located north of Interstate 10, bound on the west by U.S. Highway 31 and on the east by Alabama 59.

Zoned as a planned unit development, the property could be developed as residential, commercial or light industrial, said Shawn Alves with Stone, Grenade and Crosby, which provides legal representation for the town.

But the property was never developed and was eventually sold and split in two, the southern half to Fish River LLC, which includes just under 2,500 acres and the northern half as Fortuna Investments LLC, representing Loxley Triangle LLC.

Fish River LLC also presented an additional 426 acres for inclusion in Monday’s amendment to their PUD.

The amendments also included minor changes which reflect changes to the ordinance since the original PUD was passed in 2006, Alves said.

Both amendments were passed unanimously by the council following public hearings held at Monday’s council meeting. All council members were present at Monday’s meeting.

Any further subdivision of the properties would come before the town’s Planning Commission for plat approval and any further rezoning recommendations, which would have to be approved by the town council, Alves said.

In other business Monday, the council voted unanimously to approve certification of election for Mayor Billy Middleton and four of the five council seats up for election Aug. 28.

Middleton, along with Wallace Sabin, Jeffrey T. Knight, Katherine Breeden and Michael Allegri qualified unopposed for municipal elections. Qualifying for this year’s municipal elections ended July 17.

Richard Teal is the only incumbent in Loxley to face opposition, seeking his seventh term in office against challenger Vicki Dyess.

Voters in Loxley will also go to the polls in August to decide whether or not they want Sunday alcohol sales within the town limits.

Baldwin County is one of 12 counties in Alabama to allow Sunday alcohol sales on a city by city basis. There are 26 counties in the state of Alabama that prohibit the sale of alcohol entirely.

In November of 2003, voters in Baldwin County approved a measure to allow the off-premise sale of beer and wine on Sunday. The off-premise sale of hard liquor is still prohibited on Sunday in Baldwin County.

Municipalities and Commission Districts were allowed to vote individually on the measure. The Town of Loxley and Commission District 2, which includes Rabun, Stockton and Tensaw, voted against the measure.

The Loxley Town Council voted in May to approve a resolution placing the referendum on the ballot for the August election.

In addition to certifying the election, the Council:

• Approved Resolution No. 2012-11 declaring Billy Middleton elected to the office of Mayor. Middleton abstained from voting on the measure.

• Approved Resolution No. 2012-12 declaring Wallace Sabin elected to the office of Town Council, Place 1. Sabin abstained.

• Approved Resolution No. 2012-13 declaring Jeffrey T. Knight elected to the office of Town Council, Place 2. Knight abstained.

• Approved Resolution No. 2012-14 declaring Katherine Breeden elected to the office of Town Council Place 3. Breeden abstained.

• Approved Resolution No. 2012-15 declaring Michael Allegri elected to the office of Town Council Place 5. Allegri abstained.

In other business Monday, the Council:

• Approved a sign request from the Robertsdale High School Quarterback Club for the purchase of 3-foot, by 8-foot banner on the press box at J.D. Sellars Stadium at a cost of $500.

• Approved Resolution No. 2012-16 assessing the cost demolition and removal of property located on Alabama Lane at $3,500, plus $138.36 for attorney’s fees in order to get reimbursement to the town by the property owner.

• Voted to set up a new bank account for the Municipal Court Judicial Administration Fund.

• Appointed Ronnie Northcutt as a member of the town’s Industrial Development Board.

• Set a public hearing for Monday, Sept. 10 for grass and weed removal on Grimes Lane.
