MAGNOLIA SPRINGS — Despite a 4-1 vote by the Magnolia Springs Town Council to vacate a 200-by-40-foot portion of Palm Street Tuesday, the issue remains unresolved.
On Thursday morning, Mayor Ken Underwood said he was told late Wednesday afternoon that upon reviewing the application made by residents James and Ann West and Tim and Sandra Russell, he discovered errors that had previously gone unnoticed.
“They were property-description related,” said Underwood, who cast the lone dissenting vote Tuesday.
However, Magnolia Springs Town Clerk Karen Biel added that no error may actually exist and that the issue is still being reviewed.
Underwood said that if the application is found to have errors, the council would be required to formally rescind its approval and the entire application process would begin again.
“We’ll have to go back to square one,” Underwood said.
The mayor added that such an action would be good news to him, as he contends that the vacation would both create a dead-end street and remove a thoroughfare to public access to Magnolia River.
“There’s time available to see if we have any citizens in favor of maintaining public access,” Underwood said.
During Tuesday’s meeting, attorney Dan Blackburn presented the council with a petition signed by 26 Magnolia Springs residents in favor of vacating the street. However, residents both for and against doing so have spoken at public hearings on the matter.
Nonetheless, with Tuesday’s vote, the council OK’d the action, with the stipulation that it agrees on a fee following an assessment of the monetary value of the property. If no errors are found in the application paperwork, that decision will stand.
