Man indicted in hit and run

FOLEY, Ala. — A Daphne man has been indicted by the Baldwin County grand jury for first-degree assault and leaving the scene of an accident with injury.

Felipe Diaz, 56, of Whispering Pines, was indicted in connection with an April 20, 2007, vehicle accident at the intersection of Baldwin County Road 65 and Airport Road in Foley, where the truck he was driving struck and injured Felix Morales Gonzalez of Doc McDuffie Road. Gonzalez's age is unknown.

According to the police report on the incident, which took place at approximately 11 p.m. on the day in question, Gonzalez was a passenger in a vehicle that was involved in an accident. When he stepped out of the vehicle he was in to check the damage, he was struck by a vehicle traveling north on County Road 65.

Gonzalez was knocked out of his shoes and into a ditch on the east side of County Road 65. He was eventually airlifted to Baptist Hospital in Pensacola.

The black Ford F-150 pickup Diaz was driving at the time of the incident was eventually found abandoned in a field, according to the police report. Vehicle debris from the accident scene was eventually matched to the pickup.

FPD investigators determined on April 23, 2007, that the pickup had been reported to Daphne police as stolen. During an interview with Diaz, he eventually admitted he was driving the vehicle when Gonzalez was struck.

Count I of the grand jury indictment notes Diaz manifested "extreme indifference to the value of human life." Count II said Diaz "did not render to said victim reasonable assistance."

Diaz remains in the Baldwin County Corrections Center under a $30,000 bond on the two-count indictment.
