New Water, Sewer, Garbage and Connection Fees for the Town of Loxley

LOXLEY, Ala. — Ordinance No. 2011-12 establishing new water, sewer, connection and impact fees and garbage fees was passed at Monday night’s Loxley Town Council meeting. This ordinance replaces No. 2009-21 and is effective immediately.

All rates are based on one residence per parcel of land and a residence is defined as a single unit providing resident living facilities for one or more persons. Also for the commercial connection fees and assessments, the base rate is subject to the Town’s current formula calculations for utility fees.

Water rates are:

First 2,000 gallons or less: $22.39 minimum monthly

First 2,000 gallons or less where the head of household is 65 or older: $18.13 minimum monthly

Next 8,000 gallons: $4.81 per 1,000 gallons

Over 10,000 gallons: $3.61 per 1,000 gallons

Sewer rates are:

Residential: $24.50 per month

Residential where head of household is 65 or older: $17.82 per month

Commercial or industrial: 80 percent of monthly water bill, minimum $25.34 per month

Connection Fees and Assessments:

Residential:

Water connection: $750.00 per service

Sewer connection: $750.00 per service

Water Assessment: $1,250.00 per service

Sewer Assessment: $1,250.00 per service

Connection and Assessment for 1” tap: $2.300.00

Connection and Assessment for 2” tap: $3.225.00

Commercial:

Water Assessment: $750.00 per service

Sewer Assessment: $750 per service

Water Impact: $1,250 per service

Sewer Impact: $1,250.00 per service

Garbage rates are:

Residential: $15.86 per month for single family dwelling, limited to two garbage cans not to exceed 50 gallons or 50 lbs.. capacity each.

Residential where head of household is 65 or older: $13.06 per month for single family dwelling, limited to two garbage cans not to exceed 50 gallons or 50 lbs.. capacity each.

Business Establishment: $19.02 per month limited to four garbage cans not to exceed 50 gallon capacity each. All businesses requiring more than four cans shall retain the services of a private garbage service.

Late Payments:

Bills are due on the 10th of the month and are late by the 15th of the month. There shall be a late fee of $3.00 assessed to each account . Customers failing to to make a full payment by noon on the 25th of each month will be disconnected for non-payment. Services may be reconnected after paying all charges and fees and a reconnection fee.

The ordinance went on to say the Town shall be able to raise rates and fees according to the Consumer Price Index for U.S. Cities and would not be required to decrease it in the event of a decrease in the CPI-U. And all applications for senior discounts must be made prior to October 1 of each year for the 12 months following October 1.

The council also passed Ordinance No. 2011-10 amending Section 12.5 referring to Temporary Vendors.

“No temporary structure, trailor, booth, or any other non-permanent structure will be granted a full-year license. Temporary vendors include but are not limited to vendors of shoes, clothes, second hand items, food, sunglasses, hats, sporting equipment, merchandise of any kind and all other vendors not operating out of a permanent structure. Temporary vendors will be charged as follows:

One Day License: $30.00

Two Day License: $50.00

Three to Seven day license: $100.00

No temporary vendor shall be licensed for more than 14 days during each calendar year.

Yard sales at the vendor’s residence shall be exempt from this ordinance provided the vendor does not conduct a yard sale for more than 10 days, consecutive or nonconsecutive during each calendar year.”

In other council business, a motion was passed to refinance a bond issue and two resolutions, No. 2011-08, supporting Community Action Agency and the Community Services Block Grant and No. 2011-09 explaining the Municipal Water Pollution Prevention Program were passed.

The MWPP Annual Report was reviewed and the Town will continue to maintain a $35,000 budget for sewer rehab and line 7,000 feet of clay for the sewer mains. They will also maintain effluent requirements contained in the NPDES Permit and to prevent the bypass and overflow of raw sewage within the collection system or at the treatment plant.

Tommy Hudson, Town Public Works director, informed the council of some grant opportunities BP has available for several projects in the works for the Town including sewer, drainage and bridge work. “We should know something more in the next four to six weeks about our chances for this grant.”

Hudson also explained the sewer rehab project is about four to six weeks from being ready to start making plans for completion as well. “The contractor has finished looking at the plans and we should be able to move forward soon.”
