BAY MINETTE, Ala. — A Baldwin County circuit judge has placed the retrial of Stephen Nodine on the Feb. 28 criminal jury trial docket, but the prosecution or defense can request an extension.
A mistrial was declared Monday by Circuit Judge Charles Partin when jurors failed to reach a verdict on murder and stalking charges involving the May 9 shooting death of Angel Downs at her Gulf Shores condo.
A jury found Nodine guilty of an ethics violation related to personal use of a county-owned truck while he was a Mobile County Commissioner.
Incoming District Attorney Hallie Dixon will be sworn in Jan. 17 and said she needs time to evaluate the case before deciding on a retrial.
She said she has not viewed the case file or the hundreds of exhibits introduced by the prosecution in the trial. She also said she would talk to the victim’s family before stating her decision.
Dixon will replace Judy Newcomb, lead prosecutor in the trial.
