Planning Commission approves replat reviews of multiple parcels

DAPHNE, Ala.—The Daphne Planning Commission heard a presentation from Joe Steen with 181 Venture LLC for the approval of a replat review of multiple parcels.

The four parcels, which were approved for a replat, are owned by 181 Venture LLC and Crossroads Baptist Church and located southwest of the intersection of County Road 64 and Alabama Highway 181.

Steen asked the commission for approval to redraw property lines on two parcels he owns with partners. The proposed new lines will extend Steen’s property 53 feet into the property owned by Crossroads Baptist Church.

Steen said the church was agreeable to the new property lines.

“We are here to ask for the county to give us an exemption for us to replat the property lines amongst multiple parcels. We want to move our line back 53 feet and taking a portion of the Crossroads Baptist Church property and making it one lot,” Steen said.  “It is just a simple moving of the line, there are no additional properties involved. It is still the same two lots, we are asking for approval and permission for this.”

Commissioner Cathy Barnette wanted some questions answered about the parcels before she would vote to approve the request.

“Does this not have two different zoning uses on the property?” she asked.

The church property is zoned B1, but the property owned by Steen is zoned B3. When the properties are merged the resulting parcel will have two zoning classifications.

“We have applied for a zoning change,” Steen said. “The large tract is B3 and the 53 feet is B1. The county commission has approved it, but it has to go through the planning commission. We are waiting on the county’s final approval to make it all B3 to be consistent with the rest of the B3 there.”

Barnette asked Steen to come back before the commission if the county entities did not approve the changes he proposed.

“We don’t like to have two zonings on a parcel, and when you join them that would be a problem. We don’t do contingency,” Barnette said. “If for some reason Baldwin County denies this I would ask that you come back and let us look at this again because it will have two zoning classifications.”

The commission voted 9-0 to approve the replat requests on all parcels in question.
