The P&Z Commission denied two requests for minor plat approvals at its Aug. 6 meeting.
Both requests were presented by Mike Warrington of BES Inc. for proposed subdivisions at Bay Meadows, located east of Thompson Hall Road.
SD 07-26 was for a proposed resubdivision into two lots of Lot 6, Block 3 and referred to as the Paul Ripp subdivision. The property is generally located on the south side of Derby Lane.
SD 07-27 was for a proposed resubdivision into three lots of Lot 3, Block 3 and referred to as the Sedera Darby subdivision. The property is generally located on the north side of Derby Lane.
Several residents of Bay Meadows spoke against the requests, stating the proposed resubdivisions were contrary to covenants in place at Bay Meadows. P&Z Commission Chairman Jean Wilson told the residents that they would have to file in court to enforce any covenants that may be in place.
Wilson said there were two claims of ownership on one of the lots and the proposed resubdivisions were not in compliance with the Comprehensive Plan. “Page 15 of the Comprehensive Plan states that we should support the scale and character of neighborhoods,” she said.
Wilson opened the informal review of The Colony at the Grand by stating the commission would “not discuss previous decisions or litigation.” The project (IR 07-09) is a mixture of multi-family and residential lots generally located on the north side of Old Battles Road, just west of Section Street.
Jason Tickle of the Daniel Corp. said the concept he wanted to address is for 175 acres of the property. “We believe this plan is better positioning marketwise, addresses concerns raised, includes single family dwellings and more closely adheres to the goals of the city,” Tickle said.
Sara Davis of the Point Clear Home Owners Association and A.J. Cooper, president of the District 17 Community Association raised questions about the project.
“They want to have some consideration to have some variance to the regulations but it doesn’t seem like they will give up anything,” said Cooper. “We are concerned about the height of the buildings,” Cooper said, adding they hope that in the future they will make a commitment not to build any more buildings of this nature.
Commissioner Dick Charles said he had concerns about flood control, potable water and sewer and traffic density.
Commissioner Dan McCrory said Volkert had submitted everything necessary regarding drainage.
“Clearly stormwater management and traffic are critical issues the area and the city are dealing with. Once we get a clearer direction (from the commission), we will be able to work on these in more detail,” Tickle said.
“Continue to work with the staff and bring us a proposal,” said Wilson.
In other action, the commission:
• Gave final plat approval to the Willows, a 54-lot subdivision by Scott A. Hutchinson (SD 07-28). The property is generally located on the north side of Fairhope Avenue, just east of County Road 13. There were two conditions to the approval: bond financial guarantee must be provided and the punch list completed.
• Approved the site plan for Village subdivision of Summer Oaks Stables by Danny Calhoun (SD 07-29). The four-lot property is generally located off the south side of Twin Beech Road, just south of where Summer Oaks Place dead ends. The commission accepted the site plan with flexibility for city staff to work with the county on the common wetlands area.
• Heard an informal review of a multi-family development located on the east side of Highway 98, just south of Southland Place Boulevard, (IR 07-10) Butch Brown, Cumberland Construction. The plan calls for about 165 dwellings, Class A luxury apartments, renting for $850 to $1,400 per month. James Wilson, Southland Homeowners Association expressed concerns of Southland residents regarding a planned entrance from the project that would abut the Southland property, the height of the project buildings and the lack of barriers.
• Approved 4-2 the request of Laura Ledyard for preliminary plat approval of Fairhope Stables (SD 07-19). The project calls for 92 lots on 76.42 acres. The property is generally located on the west side of County Road 13, just south of County Road 24. Wilson and Commissioner Gary Moore cast the dissenting votes.
• Approved with one abstention by Moore the request of Scott A. Hutchinson of HMR LLC for final plat approval of SD 07-23, Magnolia Commons, Phase I, a 54-lot division. The property is generally located on the east side of County Road 13, just north of Fairhope Avenue.
• Gave favorable comments on the informal review of a three-lot subdivision by Scott A. Hutchinson of HMR LLC. The Oak Lawn property (IR 07-05) is generally located on the northeast corner of U.S. Highway 98 and Nelson Road. Hutchinson was told to proceed with his plans.
