Sentencing is Nov. 17 in Elberta, Ala., assault

BAY MINETTE, Ala. — Sentencing is set Nov. 17 for an Elberta man who allegedly “sucker punched” a man Feb. 7, 2009, during a confrontation at the Elberta Social Club.

Jason Anthony Stewart, 24, of Tuscaloosa Drive was arrested Oct. 20, 2009, and released on a $10,000 bail, according to court records.

He faces up to 10 years in prison and a $15,000 fine, according to Circuit Judge Lang Floyd.

Stewart took a blind plea Oct. 14 before the second day of testimony began.

Defense attorney Sheila Stone said Stewart felt pleading was in his best interest “after much soul searching.”

The victim, Randy Lampe, pushed Stewart near a bathroom door, according to assistant District Attorney Robert Nichols.

“Jason sucker punched him and he collapsed,” Nichols said. “Then Jason kicked him twice in the face.”

Lampe suffered a broken nose and required surgical plates to repair his broken jaw, Nichols said.

Floyd also ordered a pre-sentence investigation.
