LOXLEY, Ala. — The Loxley Town Council voted unanimously on Monday to pass a pair of ordinances providing water and sewer service to an area located off of U.S. Highway 31.
The two ordinances passed Monday will allow the town to provide water and sewer service to residents between east of U.S. Highway 31, west of U.S. Highway 31 and north of Interstate 10 within the town’s limits.
First, the council passed Ordinance No. 2011-27, entering into a non-exclusive franchise agreement with Baldwin County Sewer Service LLC of Summerdale.
Under the terms of the contract, the town will contract with Baldwin County Sewer for a period of 29 years, expiring Dec. 31, 2041,with an option to renew the contract for an additional five years.
The Sewer Service can charge “reasonable” rates to customers that cannot exceed rates the company charges to customers in surrounding areas, according to the contract. The company agrees to pay the town an initial fee of $750 under the terms of the proposed contract, then will pay a franchise fee of 3 percent of its gross receipts.
The Council voted unanimously, first to suspend the rules, then voted unanimously to pass the ordinance. Council member Katherine Breeden was not present at Monday’s meeting.
The Council also voted unanimously to suspend the rules and pass Ordinance No. 2011-28 entering into a contract with North Baldwin Utilities to provide water service to the area with a point of delivery located between Shambo Road and Jenkins Pit Road, west of U.S. Highway 31. The contract calls for an initial fee of $10, plus $1.55 for every 1,000 gallons of water used. The contract also allows for annual rate increases, not to exceed 10 cents per thousand gallons.
In other business Monday, the council:
• Passed Resolution No. 2011-25 entering into an agreement with the State of Alabama for the Safe Routes to School Grant for sidewalk construction.
• Approved a request from the Central Baldwin Chamber of Commerce to be placed in the town’s budget for the upcoming fiscal year requesting the amount of $4,200 to help meet the cost of overhead to run the Chamber.
• Passed Ordinance No. 2011-26 amending the town’s Business License Code.
