On Tuesday May 26, at the City Council meeting Mayor Tim Kant briefly addressed the specific request of Tree Committee Chairman Bobby Green for the city to explain the many tree ordinance violations that exist at the Publix project, and why the developer has not been required — like that of the preceding Shellbrook Apartment Complex development — to fully remediate the violations.

Much to no one’s surprise Mayor Kant said that after looking into the situation, the city found no problems.

With this specious statement the mayor has gone on official record proving that he regularly exercises favoritism for certain developers. This is further evidence that can and certainly will be used against him in the ongoing Dyas Lawsuit, which principally alleges favoritism.

Fairhope’s luster, because of its government, is really just a faux finish. Flowers, albeit sweet, do not make a government, or a city.

I am encouraged by the Courier’s efforts, the efforts of new citizens getting involved in the process, and the continued efforts of the activists that call for justice and sanity in our governmental affairs.

However, there comes a time when the continued silence of our council and the district attorney’s office amounts to a dereliction of duty. The ongoing refusal of our elected officials to answer questions repeatedly posed to them by citizens will only spawn more costly lawsuits and paralyzing anarchy.

Fairhope and any other American city under the United States Constitution deserves much better.
