Troy MacDonald capital trial reset to Nov. 29

BAY MINETTE, Ala. — The capital murder trial of a Fairhope man accused in the rape and murder of Brianna Parish has been reset for Nov. 29, after defense attorneys requested more time to prepare for the case.

Circuit Judge Charles Partin on Tuesday denied a motion for a continuance until January 2011, and said the Nov. 29 date was enough time to prepare, according to Chief Assistant District Attorney Michael Pylant. The trial earlier was scheduled to begin Oct. 4.

Troy MacDonald, 45, of Randall Avenue, is charged in the death of Parish. Her body was found Nov. 14, 2008, near the Daphne Utilities sewage plant.

A search team organized by Parish’s family discovered her half-naked body. She was last seen around 1 a.m. two days earlier at Bay House Pub.

The cause of death was blunt-force injuries to the head, according to court records.

Defense attorney Pascal Bruijn argued Tuesday that more time was needed to examine DNA evidence, review hundreds of photographs and numerous surveillance tapes associated with the case, and retain a clinical psychologist.

Bruijn also said he needed time for an expert to examine cell phone tower triangulation data which will be used to show MacDonald’s whereabouts at the time of the murder.

MacDonald was arrested Dec. 23, 2008, and indicted Feb. 13, 2009.
